These Terms set out the general framework for our services. The specific conditions applicable to each instruction will be detailed in the corresponding proposal.

Contracting & scope
1. Purpose and scope
These Terms of Service govern the contracting and provision of services offered by Mangata Care, the trading name under which Daniel Martínez Mata provides the services described on this website. Full identification and contact details are available in the Legal Notice.
Mangata Care provides specialist technical supervision, assessment, diagnostics, documentation, follow-up and support for residential properties, primarily in the areas of electrical systems, connectivity and telecommunications, and selected smart-home systems.
Services are provided primarily across the Valencian Community and the Balearic Islands. Due to the geographical and logistical characteristics of each territory, certain planning, travel, rescheduling or cancellation conditions may vary depending on the location of the property and the nature of the work.
These Terms provide the general framework for the service. The specific scope, price, planning and other particular conditions applicable to each instruction will be set out in the relevant proposal, quotation or contractual documentation.
Any specific conditions expressly accepted by the client will take precedence over these general Terms in respect of the matters they specifically regulate, subject always to applicable law.
2. Enquiries, proposals and contracting
Submitting a form through this website, sending an email or message, or making any other enquiry does not automatically create a contract or require Mangata Care to accept an instruction.
Once an enquiry has been received, Mangata Care will assess the circumstances and determine whether the requested work falls within its scope.
Where appropriate, the client will receive a proposal, quotation or equivalent document setting out, as applicable, the proposed scope, price, payment conditions, planning, travel requirements and any other relevant circumstances.
Acceptance and, where applicable, payment may be completed through the electronic channel indicated by Mangata Care, including a management platform, CRM/ERP system, payment link or other authorised method.
The contract will be considered entered into once the client has clearly accepted the proposal and any applicable initial conditions have been fulfilled.
Where the client is legally considered a consumer and the contract is concluded at a distance, the legally required pre-contractual information will be provided before the client becomes bound.
3. Scope of the services
The scope of each instruction will depend on the service contracted, the characteristics of the property, the systems installed, the needs identified and the accessibility of the relevant areas and equipment at the time of the visit.
Mangata Care will carry out the checks corresponding to the service agreed in advance and on those elements that are reasonably accessible.
A scheduled supervision visit is not necessarily as comprehensive as an Initial Technical Assessment, just as a one-off visit relating to a specific fault does not imply a general review of all systems within the property.
Mangata Care’s supervision services do not constitute a statutory inspection or OCA inspection where such an inspection is legally required, nor do they replace certifications, statutory maintenance or work that must be carried out by authorised inspection bodies, official technical services or other specifically qualified professionals.
Unless expressly agreed as part of a specific service, Mangata Care does not provide full property management, booking or guest management, cleaning or other services typically associated with property management or concierge services.
The service does not constitute permanent monitoring of the property and cannot guarantee that faults, deterioration or other incidents will not arise subsequently.
4. Initial Technical Assessment
The Initial Technical Assessment is a professional service with its own defined scope and economic value.
Its price and conditions will be communicated to the client before contracting.
As a general rule, the Initial Technical Assessment will be paid for before it is carried out, by bank card or bank transfer, unless the accepted proposal expressly provides otherwise.
Once the Initial Technical Assessment has been fully completed, its price relates to a service that has already been provided.
If the client subsequently decides not to enter into an ongoing supervision programme, the Initial Technical Assessment will retain its full price, without prejudice to any statutory withdrawal rights that may apply where the client is a consumer.
Where the client subsequently enters into one of Mangata Care’s supervision programmes, the amount already paid for the Initial Technical Assessment will be credited against or deducted from the price of that programme, in accordance with the financial terms set out in the proposal.
There is therefore no need to refund the Initial Technical Assessment and charge the client again: the amount already paid will simply be taken into account within the programme price.
The Initial Technical Assessment is not a free service. Its financial inclusion within a supervision programme is a benefit linked to the effective contracting of that programme.

5. Supervision programmes
Mangata Care offers different ongoing supervision programmes, including Mangata Core, Mangata Continuity and Mangata Signature.
The number and type of reviews, services included, financial conditions and other features of each programme will be those set out in the proposal accepted by the client.
Programmes are contracted for an initial period of 12 months from the date specified in the contractual documentation.
Interventions, repairs or other work that fall outside the scope expressly included in the programme will not be considered automatically included.
Where a supervision visit identifies a need that requires additional work, the client will be informed and the scope and, where applicable, price of that work will be defined before it is carried out.
6. Renewal of programmes
At the end of the initial 12-month period, the programme will renew automatically for successive periods unless the client gives notice that they do not wish to renew at least 45 days before the renewal date.
Notice may be given by email or through any other channel made available by Mangata Care that provides reasonable evidence that it has been sent.
Where the client is legally considered a consumer, Mangata Care will also provide a reminder at least 15 days before the deadline for giving notice of non-renewal, informing the client that the deadline is approaching and of the consequences of not giving notice.
Where the financial conditions applicable to the next period are due to change, Mangata Care will inform the client sufficiently in advance and before the deadline for giving notice of non-renewal.
The 45-day notice period applies to non-renewal at the end of the current term and does not limit any statutory rights the client may have to terminate the contract earlier.
7. Early termination of a programme
The client may request to end the programme before its expiry through a channel that allows the request to be reasonably evidenced.
Where the client is legally considered a consumer, they may exercise any statutory right to terminate an ongoing service through the same type of channel used to enter into the contract, without disproportionate obstacles, penalties or charges.
Where early termination takes place, a transparent final calculation may be carried out taking into account the services already provided, amounts already paid and the financial conditions previously accepted.
An Initial Technical Assessment that has already been completed, or any other service already provided, will retain its corresponding economic value.
Where the accepted proposal expressly includes discounts or financial benefits linked to the annual commitment, any adjustment resulting from early termination must have been disclosed in advance and must be applied proportionately and in accordance with applicable law.
Services that have not yet been provided will not automatically be charged, and disproportionate penalties will not be imposed.

8. Planificación y acceso a la vivienda
Visits will be carried out on the agreed date or within the agreed time window, taking into account the type of service, the location of the property, technical availability and access arrangements.
The homeowner does not need to be present during the visit where an authorised access procedure has been agreed in advance.
Access may be arranged directly with the homeowner, through an authorised person, via an estate agent or other professional appointed by the client, or by any other method agreed in advance.
Mangata Care does not assume permanent custody of keys, access codes or other means of entry by default. Any specific arrangement relating to the custody of access credentials must be expressly agreed.
The client must provide reasonable access to the installations, equipment, consumer units, devices or areas included within the agreed scope.
Where certain elements cannot be accessed, the review will be limited to what can reasonably be checked, and any relevant limitation will be recorded where appropriate.
9. Changes, cancellations and failed visits
Valencian Community
For standard visits in the Valencian Community, the client may request a change of date with at least 24 hours’ notice, subject to availability.
Where less notice is given, Mangata Care will still try to offer an alternative date where reasonably possible.
If a late cancellation or change results in actual costs that were disclosed to the client in advance, those costs may be charged in accordance with the terms of the relevant proposal.
Where the technician has travelled to the property but the agreed work cannot be carried out because access is unavailable or because of another circumstance attributable to the client or the person responsible for providing access, any previously disclosed travel or failed-visit charge may apply.
Balearic Islands
Work in the Balearic Islands may require specific logistical planning that differs from the normal arrangements used in the Valencian Community.
Where necessary, the proposal may set out specific conditions relating to transport, travel, bookings, dates or intervention windows, accommodation where applicable, and changes or cancellations.
Any foreseeable logistical costs will be disclosed before contracting.
Where a change or cancellation requested by the client results in third-party costs that Mangata Care has already incurred and that cannot be recovered, those costs may only be passed on where they were disclosed in advance and are reasonably justifiable.
These operational conditions apply without prejudice to any statutory withdrawal rights available to a consumer.
If Mangata Care is unable to carry out a scheduled visit because of unforeseen circumstances, the client will be informed as soon as reasonably possible and an alternative will be proposed.
If the service ultimately cannot be provided, any amounts paid specifically for services that have not been carried out will be refunded or otherwise credited as appropriate.
10. Incidents, technical hours and availability
Mangata Care may assess incidents relating to systems within its scope, both for properties covered by an ongoing supervision programme and, where possible, through one-off technical support.
The priority given to an incident will depend on its severity, potential risk, extent, impact on essential services, location, access conditions and technical availability.
Situations involving serious technical risk or the total loss of an essential service — such as a significant electrical fault or a complete loss of electrical supply to the property — may be treated as particularly urgent.
Partial faults or situations that do not involve an immediate risk or complete loss of service will not automatically be classified as critical incidents.
Mangata Care’s normal technical hours are Monday to Friday, 08:00–16:00, excluding public holidays or where different arrangements have been agreed.
For certain critical incidents, Mangata Care may work towards a response time of up to 4 hours within normal technical hours, subject to the service contracted, location, distance, access, actual availability and the nature of the incident.
This is an operational response target and not a general guarantee of attendance within that period in all circumstances.
Mangata Care does not provide a general 24-hour emergency service. Any possible support outside normal technical hours will depend on the seriousness of the situation, actual availability and prior acceptance of the applicable conditions.
11. Additional work and third-party specialists

12. Prices, initial payment, SEPA and invoicing
The price of each service will be communicated before contracting through the relevant proposal, quotation or equivalent document.
The amounts stated will reflect the agreed scope and any taxes legally applicable.
Any foreseeable additional costs to be borne by the client, including where relevant certain travel or logistical costs, will also be communicated before contracting.
The initial payment will be made by bank card or bank transfer.
Where card payment is processed through a management platform, CRM/ERP system, payment gateway or external provider, the client will be directed to the secure payment process made available for that purpose.
For ongoing supervision programmes, subsequent payments may be collected by SEPA Direct Debit, in accordance with the agreed payment schedule and subject to the appropriate mandate or authorisation being in place.
Mangata Care will issue the corresponding invoices in accordance with applicable law.
13. Failed or outstanding payments
Where a payment cannot be completed, is rejected or a Direct Debit is returned, Mangata Care may ask the client to settle the outstanding amount using one of the available payment methods.
Where amounts are due and remain unpaid, future services under the programme may be temporarily suspended until the payment position has been regularised, following prior notice to the client and provided that such suspension is proportionate.
No automatic surcharges, penalties or additional costs will be applied unless they have been clearly established in advance and are legally enforceable.
The client must provide sufficient and accurate information about the property and the technical need or situation concerned.
Where relevant, the client should inform Mangata Care of known faults, alterations to installations, recent work carried out by third parties or any other circumstances that could affect the safe or proper delivery of the service.
The client is responsible for ensuring that any person appointed to provide access or instructions has the necessary authority to do so.
Mangata Care will not be responsible for consequences arising directly from essential information that is inaccurate or has been omitted by the client where that information could not reasonably have been identified during the service.
14. Client responsibilities
15. Liability and circumstances beyond our control
Mangata Care will provide its services with appropriate professional care and within the agreed scope.
Any checks carried out reflect the observable or measurable condition of the systems included at the time of the visit.
Mangata Care cannot guarantee the absence of hidden defects, future faults or issues that could not reasonably be identified through the checks included within the contracted service.
Mangata Care is also not responsible for the operation or availability of services and infrastructure controlled directly by third parties, such as telecommunications providers, utility companies, manufacturers or technical service providers, without prejudice to any diagnostic, documentation or follow-up work included within the agreed service.
Nothing in these Terms excludes or limits any liability that legally rests with Mangata Care for its own acts or omissions, or any mandatory rights available to consumers.
The planning or delivery of a service may also be affected by circumstances reasonably beyond Mangata Care’s control, including severe weather, transport disruption or restrictions, unexpected loss of access or other force majeure events.
Where such circumstances prevent an agreed visit or service from being carried out, the client will be informed and a reasonable alternative will be sought.
RIGHTS & LEGAL FRAMEWORK

16. Consumer right of withdrawal
Where the client is legally considered a consumer and the contract is concluded at a distance or away from business premises, they will generally have 14 calendar days from the date on which the service contract is entered into to exercise their right of withdrawal, without having to give a reason.
In the specific circumstances provided for by law where a contract is concluded following an unsolicited visit by the business to the consumer’s home or during an excursion organised for the purpose of promoting or selling services, the withdrawal period is extended to 30 calendar days.
Where the consumer asks Mangata Care to begin providing a paid service before the withdrawal period has expired, Mangata Care must obtain the consumer’s express request for early performance and, where applicable, their acknowledgement of the consequences of full performance for their right of withdrawal.
If the consumer withdraws after expressly requesting that the service begin, but before it has been fully performed, they may be required to pay a proportionate amount for the part of the service already provided, where the statutory requirements have been met.
Once a service has been fully performed, the right of withdrawal may cease to apply where performance began with the consumer’s express prior consent and acknowledgement that the right would be lost once the service had been fully completed.
This is particularly relevant where a client asks for an Initial Technical Assessment to be carried out before the statutory withdrawal period has expired.
The request for early performance must be recorded expressly as part of the contracting process. Its inclusion in these Terms alone does not replace the consumer’s specific consent.

17. Data protection, communications and complaints
Personal data provided in connection with an enquiry, contracting process or service will be handled in accordance with applicable data protection law and Mangata Care’s Privacy Policy.
Communications relating to the service may be made using the contact details and channels provided by either party.
Any notice relating to non-renewal, cancellation or termination should be sent through a channel that provides reasonable evidence that the communication has been made.

Consumer complaints will be handled through the available communication channels and answered as soon as reasonably possible and, in any event, within a maximum of 15 days from the date on which the complaint is submitted.
Where a consumer complaint cannot be resolved satisfactorily, any legally applicable consumer complaint or alternative dispute-resolution procedures will remain available.
18. Changes to these Terms
Mangata Care may update these Terms where necessary to reflect changes in legislation, technical or operational requirements, or the way its services are structured.
Updated versions will not retrospectively alter the specific conditions applicable to services that have already been contracted.
Where a change materially affects an ongoing supervision programme, the client will be informed in accordance with applicable law and with any notice period that may be required.
The version applicable to each contract will be the version in force when that contract is entered into, together with the specific conditions contained in the accepted proposal.
19. Governing law
These Terms are governed by the laws of Spain.
Where the client is legally considered a consumer, all mandatory consumer rights and protections applicable to them will remain fully respected, and nothing in these Terms should be interpreted as a waiver of those rights.
Additional or specific contractual terms may be agreed in proposals or contracts entered into with businesses or professional clients.
